On September 19-20, 2019, the Guangdong Provincial Court System held a symposium on the trial of ecological environment infringement liability disputes in Longgang District, Shenzhen. The symposium was organized and convened by the Environmental Resources Division of the Guangdong Higher People ’s Court, from the Provincial High Court, the Procuratorate, the Provincial Department of Natural Resources, the Provincial Department of Ecology and Environment, the Guangzhou Municipal Bureau of Justice, the Provincial Lawyers Association, the South China Institute of Environmental Science, More than 40 experts and scholars such as judicial institutions, administrative departments, universities, scientific research institutes, lawyers' organizations such as some middle and primary courts, Sun Yat-sen University, and South China Agricultural University participated in the two-day meeting. Professor Wang Quandian, Director of the Research Center for the New Urbanization Rule of Law of the Provincial Law Society's South China Agricultural University Base, was invited to participate in the symposium, mainly expressing professional opinions on the Guidelines of the Guangdong Higher People's Court on the Trial of Environmental Tort Liability Disputes (Draft for Comment).
The symposium focused on the draft guidelines issued by the Guangdong Higher Court for the trial of environmental tort liability disputes. The aim was to properly review environmental tort liability disputes in accordance with the law, unify the judgment standards, and improve the trial of environmental tort liability disputes across the province. quality. Experts and scholars at the meeting conducted extensive and enthusiastic discussions on environmental tort liability and several people's tort liability, relevance and causality, environmental pollution notarization and evidence preservation, environmental restoration and other content matters. Professor Wang Quandian mainly focused on the purpose and scope of the guidelines, the sharing of environmental tort liability of several people, the determination of relevance and causality, whether the relevant expressions conform to the rules of evidence in civil litigation, and the boundary between environmental private interest infringement litigation and environmental public interest litigation. The organizer will summarize and absorb relevant discussion opinions as a reference for further revision of the guidelines.
